Libel Suits Dropped
Monday, 10 August 2009

August 10--  After nearly two years of litigation, two more court cases spawned in the aftermath of the Dale Clark administration in the Montgomery County School System have been dropped.

In October, 2007, the former Montgomery school superintendent sued Dale and Deloris James of Alston for libel and slander.  Clark claimed the two had engaged in a personal vendetta which caused her to be removed from her position.

In response, James and his wife denied Clark's claims in a November, 2007 court filing which also asked the court to dismiss her case and require her to pay punitive damages and all costs related to the case.

According to Francis Stubbs, the attorney for the James family, both parties in the litigation have mutually agreed to dismiss their cases with prejudice which means the cases willl not be filed again by either party.
